Terms of Service

1. Agreement to Terms

By accessing and using Miinify ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Miinify is a cloud deployment platform that enables users to:

  • Deploy web applications, containers, and static sites
  • Manage deployments through an intuitive dashboard
  • Configure custom domains and SSL certificates
  • Monitor application status and view deployment logs
  • Integrate with GitHub for continuous deployment

3. User Accounts

3.1 Account Creation: You must create an account to use the Service. You may register using GitHub or Google OAuth authentication.

3.2 Account Security: You are responsible for maintaining the security of your account and password. You must notify us immediately of any unauthorized access.

3.3 Account Information: You must provide accurate, current, and complete information during registration and keep it updated.

3.4 Age Requirement: You must be at least 13 years old to use the Service. If you are under 18, you must have permission from a parent or guardian.

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights of others
  • Upload malware, viruses, or malicious code
  • Engage in spamming, phishing, or fraudulent activities
  • Mine cryptocurrency (Strictly Prohibited - Immediate Ban)
  • Deploy illegal content, including pirated software
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service or servers
  • Use the Service for denial-of-service attacks
  • Resell or redistribute the Service without authorization

5. Subscription and Billing

5.1 Free Trial: New users may receive a free trial period. No payment method is required during the trial.

5.2 Paid Plans: After the trial, you must subscribe to a paid plan to continue using the Service. Pricing is available on our website.

5.3 Billing: Subscriptions are billed monthly or annually in advance. Payments are processed through Stripe.

5.4 Auto-Renewal: Subscriptions automatically renew unless you cancel before the renewal date.

5.5 Refunds: We offer a 14-day money-back guarantee for new subscriptions. Refunds for subsequent billing periods are at our discretion.

5.6 Price Changes: We may change subscription prices with 30 days' notice. Changes apply to subsequent billing periods.

6. Service Availability

6.1 Uptime: While we strive for 99.9% uptime, we do not guarantee uninterrupted service. Scheduled maintenance will be announced in advance.

6.2 Service Modifications: We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

6.3 Resource Limits: Usage is subject to resource limits based on your subscription plan. Excessive usage may result in throttling or additional charges.

7. Your Content

7.1 Ownership: You retain all rights to your deployed applications and content. We claim no ownership over your code or data.

7.2 License to Us: You grant us a limited license to host, store, and display your content solely to provide the Service.

7.3 NO BACKUP LIABILITY (CRITICAL):
Miinify is a compute platform, not a storage service. We do NOT provide backups for persistent volumes or local container storage. You acknowledge that any data stored on the local file system of your container is ephemeral and may be lost during restarts or redeployments. You operate at your own risk and are solely responsible for backing up your data to an external service (e.g., AWS S3, MongoDB Atlas).

8. Intellectual Property

The Service and its original content (excluding your deployed applications), features, and functionality are owned by Miinify and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

9. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as described in our Privacy Policy.

10. Termination

10.1 By You: You may terminate your account at any time through the dashboard settings. Termination is effective immediately.

10.2 By Us: We may terminate or suspend your account immediately, without prior notice, for conduct that violates these Terms or is harmful to other users, us, or third parties.

10.3 Effect of Termination: Upon termination, your right to use the Service ceases immediately. Your deployments will be taken offline, and your data will be deleted after 30 days.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

12. Limitation of Liability

IN NO EVENT SHALL MIINIFY, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA, OR USE, ARISING OUT OF YOUR USE OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS.

13. Indemnification

You agree to indemnify and hold harmless Miinify and its affiliates, officers, agents, and employees from any claim, demand, loss, or damages, including reasonable attorneys' fees, arising out of your use of the Service, your violation of these Terms, or your violation of any rights of another.

14. Dispute Resolution

14.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of your jurisdiction, without regard to conflict of law provisions.

14.2 Arbitration: Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except where prohibited by law.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the dashboard. Your continued use of the Service after changes constitutes acceptance of the new Terms.
